Have always wanted a Remington 700 Specialty Pistol and finally secured an undesignated virgin Remington 700 action, along with a letter from the ATF, as well as Remington saying that the action was sold as bare and never a part of a rifle. Going to make a 13" 308 Winchester and cut down a MDT LSS chassis to make a pistol stock. Excited about this project and looking forward to taking a mule deer with it this winter. Long time dream of mine finally coming true.

I've never seen an action with "Specialty Pistol" demarcated on the side. Never gotten a letter distinguishing an action as "undesignated" from the ATF.

Is there as reason for all these?

I like the stock.

The "Specialty Pistol" is just custom work. The letter from the ATF was saying that the build is legal as long as a letter was obtained from Remington stating that the action was a new, never assembled as a rifle, action.

I was not aware that you had to have such a letter. As long as the 4473 says "Other" on it when purchasing a virgin action, I thought you were good to go.

Here's what I received from ATF:

Good afternoon Mr. Weiser,



Thank you for your inquiry to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). This is in response to your recent email regarding the building of a rifle caliber bolt action handgun.



You stated;

I am writing you in reference to the below letter correspondence from 1992 and to attain a similar clarification. I am interested in purchasing a factory new bare or "virgin" Remington 700 bolt action receiver (that has never been assembled into a rifle) and then use that receiver to build a rifle caliber bolt action handgun similar to the Remington XP-100R to use for steel silhouette target shooting and hunting. I just want to make sure this is still allowable and if so, are there any special instructions I need to follow (or ways it should be logged) when picking up the new receiver from my FFL.

The information that was provided in 1992 still applies. Utilizing the receiver of an existing rifle for the purposes of manufacturing a handgun would constitute the making of a firearm as defined above. Individuals desiring to make such a firearm must first submit an ATF Form 1, Application To Make And Register a Firearm and pay the applicable $200 making tax.

If an individual were to obtain a rifle type receiver that had not previously been utilized in the assembly of a rifle, a handgun could be made and not be subject to the provisions of the NFA. Verification must be obtained from the manufacturer of the receiver to establish its authenticity. I would recommend that the verification received from the manufacturer be attached to the ATF Form 44473 at the time of transfer and that you retain a copy as well.


There may be state laws regarding this issue. You should forward all inquiries as to State law to your State?s Attorney General Office or a Federal Firearms Licensee who if familiar with your specific state laws regarding firearms. A listing of the State Attorney General offices is available online at http://www.naag.org.
